These Terms and Conditions ("Terms") govern your access to and use of our website at painterpro.com (the "Site"), our services, including residential and commercial painting, cabinet painting, and any related offerings (collectively, the "Services"), and any communications we send via SMS, email, or other channels. By accessing the Site, requesting a quote, booking a service, or engaging with our SMS campaigns (e.g., via TextMagic), you agree to these Terms. If you do not agree, please do not use the Site or Services.

Use of the Site and Services

  • Eligibility: You must be at least 18 years old to use our Services. By using the Site or Services, you represent that you meet this requirement.
  • Permitted Use: The Site and Services are for personal and business use only. You may not use them for any illegal purpose, to harass others, or to interfere with our operations.
  • Account Creation: To book Services or receive SMS updates, you may need to provide contact information. You agree to keep this accurate and notify us of changes.
  • SMS Campaigns: By opting in to our SMS services (e.g., replying "YES" or providing your number via a form), you consent to receive promotional messages, appointment reminders, and service updates from Painter Pro. Message frequency varies; standard rates apply. Reply "STOP" to opt out at any time. For help, reply "HELP" or contact us at the details below. Carriers are not liable for delayed or undelivered messages. T-Mobile, AT&T, Verizon, and others are supported, but delivery is not guaranteed.
  • Prohibited Conduct: You agree not to: (a) copy, modify, or distribute Site content without permission; (b) use automated tools to scrape data; (c) transmit viruses or harmful code; or (d) impersonate others.

2. Services and Estimates

  • Estimates and Quotes: All estimates are free and non-binding until a written contract is signed. Prices may change based on site inspection, material costs, or unforeseen issues.
  • Service Description: We provide high-quality interior/exterior residential painting, commercial painting, and cabinet refinishing in areas including Plainfield, Avon, Bloomington, and surrounding Indiana communities. Services include preparation, application, cleanup, and our free touch-up program for up to one year.
  • Scheduling and Changes: Appointments are subject to availability. Cancellations require 24 hours' notice; late fees may apply for no-shows.
  • Guarantees: We offer industry-leading warranties on workmanship (typically 2 years) and materials (per manufacturer). Details provided in your contract.

3. Payments and Refunds

  • Payment: Accepted via cash, check, credit card, or financing options. Full payment is due upon completion unless otherwise agreed.
  • Refunds: Refunds are at our discretion for incomplete services. No refunds for completed work unless due to our material breach.
  • Taxes: You are responsible for applicable sales taxes.

4. Intellectual Property

All Site content, logos, and tools (e.g., any future color visualizer) are owned by Painter Pro or licensors. You may not reproduce them without written consent.

5. Limitation of Liability

  • To the fullest extent permitted by law, Painter Pro is not liable for indirect, incidental, or consequential damages (e.g., property damage beyond our control, lost profits). Our total liability shall not exceed the amount paid for the Services.
  • We carry general liability insurance, but you should maintain your own homeowners/renters insurance.

6. Governing Law and Disputes

These Terms are governed by Indiana law. Any disputes shall be resolved in Hendricks County courts. We encourage informal resolution first—contact us before legal action.
